A clear precedent has been set by the courts. There is no distinction between "business" and "non-business" use of a company provided fleet vehicle in the case of an accident involving liability claims.
An employer is 100% responsible for their company vehicles during both “business” and “non-business” hours. This is regardless of any internal policy a company may have in place and is also regardless of who is operating the vehicle.
